Mycelial.Earth ("Mycelial," "we," "us," or other applicable first-person pronouns) is providing this Privacy Notice and the Cookie Notice (together, the "Notice") to explain how we collect, use, disclose, safeguard, transfer, access, dispose of, and otherwise process (collectively, "Process") the Personal Information (defined below) we collect. For example, the Notice covers:

  • Personal Information collected through https://mycelial.earth (our "Site") and the platform accessible through our Site;
  • Personal Information collected when you interact with social media links on our Site and our official accounts on social media and content publishing platforms;
  • Your communications with us via phone, email, text, and other forms of electronic messages, including interactive chat functions;
  • The services we provide to our users;
  • Our marketing activities; and
  • Any offline business interactions you may have with us.

As such, this Privacy Notice does not apply to:

  • Websites, products, or services that link to or reference different privacy policies or notices.
  • Personal Information that is collected by any third party. Those third parties have their own privacy practices, and we encourage you to review them, specifically by reading any available privacy policies, before providing Personal Information to or through them.
  • Personal Information we collect about employees or job applicants.
  • Information that is not personal, like anonymous, de-identified, or aggregated data (for example, summary statistics), even if it comes from Personal Information.

We may provide additional or supplemental privacy notices for specific products or services that we offer at the time of collection. Unless otherwise noted, those supplemental notices should be read together with this Notice. In the event of a conflict or inconsistency between this Notice and any supplemental privacy notice, the supplemental privacy notice controls.

Effective Date and Changes to this Privacy Notice

This Privacy Notice is effective as of the "Last Updated and Effective Date" above and will remain in effect except with respect to any provisions that are changed in the future. Mycelial may make changes to this Privacy Notice from time to time. Changes will be effective immediately upon their posting to the Site or upon you being otherwise notified. You are expected to check this page regularly so you are aware of any changes, as your continued use of the Services following the posting of a revised Privacy Notice means that you accept and agree to the changes. We will also revise the date found at the beginning of this Privacy Notice when we post changes to it.

Children's Information

Mycelial does not direct its services to minors, and we do not knowingly collect Personal Information from minors. If you are under 13 (or the age of majority where you live), please do not visit the Site, use our services, engage with us on social media, or otherwise provide us any information. If we become aware that a minor has provided us with Personal Information without compliant consent under applicable law, we will take steps to comply with any applicable legal requirement related to such information.

Personal Information We Collect about You

For the purposes of this Notice, "Personal Information" is broadly defined to mean information that can identify an individual directly or indirectly through reasonably available information and includes the definitions of "personal information," "personally identifiable information", "personal data," and other analogous terms under applicable data protection laws.

The Personal Information Mycelial Processes about you depends on how you use our Services. For example, we collect different information if you visit our Site than if you use our platform.

Generally, we collect several types of information, which may include Personal Information, from and about you, including information:

  • By which you may be directly and personally identified, such as name, email address, telephone number, and video and audio recordings of you when you choose to communicate with us and other users via web conference.
  • That is about you individually but does not directly identify you, such as employment and education information.
  • That is about your internet connection, the equipment you use to access our Site, and usage details, such as your Internet Protocol address and device and application identification number.

If we combine or connect non-Personal Information in such a way that it directly or indirectly identifies you, we treat the combined information as Personal Information.

The purpose of Mycelial's platform is for you to connect with other users. To do so, a profile that contains information about or pictures of you may be accessible to other users and the information within your profile may be shared with other users. Through your profile and communications with other users, you might choose to provide any type of Personal Information. We encourage you use caution with the information that you share. For example, you should never provide information such as your Social Security, driver's license, state or national identification card number, financial account, debit card, or credit card number, password, or credentials allowing access to an account to any other user. You can review your profile and communications with other users to determine what Personal Information has been shared there.

Some of our Services require a payment. When this happens, we will direct you to Stripe, a payment gateway. When using Stripe, you are disclosing your payment card information directly to Stripe and not to Mycelial. To better understand how Stripe uses the information shared with it, check its privacy policies.

The categories and specific types of Personal Information that we have collected in the last 12 months are listed below. Please note that some types of Personal Information are duplicated among categories.

Sensitive Personal Information
Financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account necessary to process payments through Stripe.

Generally, when you provide us Sensitive Personal Information, you do so voluntarily. In certain instances, we may require your Sensitive Personal Information in order to process certain requests. We may deny your request if you do not provide the required information.

How We Collect Personal Information about You

The information we collect about you comes from a number of sources and in a variety of ways, including information you provide to us, information we obtain from third parties, information we automatically collect through technology, and information we derive or infer about you. The Personal Information we collect depends on how you interact with us and which Services we are providing.

Personal Information You Provide to Us

We collect Personal Information directly from you, for example:

  • You may provide Personal Information when you correspond with us by web conference, email, chat application, or otherwise; complete online forms or surveys; or interact with our social media accounts.
  • As described above, the information you share on and through your profile in the platform may include Personal Information.
  • You may be required to provide Personal Information if you sign up for the Services we provide our users. You may elect not to provide this information under these circumstances, but we may be unable to meet your request for Services if you do so.

Personal Information Collected from Other Sources

We may also collect Personal Information about You from other sources, including our service providers, third parties, or public information sources, such as:

  • Through our users.
  • Through social media networks such as LinkedIn.
  • From our service providers that enhance our data.

Personal Information Collected Automatically

We may also automatically collect Personal Information by (technologically) observing your interactions with our Site. We collect this information through the use of "cookies" and similar tracking technologies. You can learn more about this from our Cookie Notice.

How We Use Your Personal Information

Mycelial may use your Personal Information for the following purposes:

  • Run and manage our business in the ordinary course and keep our records up to date.
  • Provide our users with our Services.
  • Fulfill requests you make and respond to your inquiries.
  • Provide customer service and resolve technical support issues.
  • Respond to your inquiries, including to investigate and address your concerns and monitor and improve our responses.
  • Communicate with you regarding developments within our business or other products or services we or our business partners may offer that may be of interest to you. If you do not want to receive communications regarding products, services, events, or other things that we consider may be of interest to you, you may let us know by clicking on the unsubscribe link in electronic marketing communications.
  • Improve our Services and develop new services.
  • Improve our artificial intelligence algorithms.
  • Notify you about changes to our Services and our Site.
  • Resolve technical support issues.
  • Present our Site and its contents to you.
  • Improve our marketing and Customer Relationships and experiences.
  • Conduct research and create reports from analysis of usage patterns and trends and to deidentify or aggregate Personal Information to create business and market analysis and reports.
  • Protect our Services, employees, operations, or any other person or business.
  • Carry out our obligations and enforce our rights arising from any contracts entered into between our users and us, including for billing and collection.
  • Cooperate with law enforcement and protect the rights, interests, safety, or property of Mycelial and others.

  • Fulfill the purposes for which you provided the information or that were described when it was collected.
  • For any other purpose with your consent.

Disclosing Your Personal Information

In addition to the specific situations discussed elsewhere in this Privacy Notice, we may disclose your Personal Information to:

  • Any Mycelial holding company, subsidiary, or affiliated or related entity.
  • A buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our assets, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding, including in contemplation of such transactions. Your information may be among the shared or transferred business assets.
  • Business partners, vendors, service providers, subcontractors, and other third parties we use to support our business.
  • Law enforcement officials or regulatory authorities.
  • Any third party with your consent.

We may disclose your Personal Information for the following purposes:

  • Fulfill any of the ways listed above in which we use your Personal Information.
  • Fulfill the purpose for which you provide it.
  • Comply with any court order, law, subpoena, or other legal process, including to respond to any government or regulatory request.
  • Enforce or apply any agreements between us and our users, you, or any other third party.
  • Protect and defend our rights, safety, and property; our Site; the users of our Site; our users; and others.
  • When we otherwise believe in good faith that the provision of such information is required or permitted by law, such as in connection with the investigation or assertion of our legal defenses or for our compliance matters.

We Do Not Sell or Share Your Personal Information

You have the right to know whether your Personal Information is being sold or shared and to opt out of this practice. For the purpose of this Notice, Personal Information is sold when it is transferred or made available to a third party in exchange for money or other valuable consideration (this does not include transfers to a third party as an asset that is part of a merger, acquisition, bankruptcy, or other transaction) and it is shared when it is provided to a third party to display advertisements to you that are predicted to be relevant to your preferences or interests based on the Personal Information obtained or inferred from your activities across nonaffiliated websites, applications, or online services ("targeted advertising").

Mycelial does not sell or share your Personal Information. In the preceding 12 months, we have not sold or shared any Personal Information of consumers. You can learn more about this from our Cookie Notice.

Artificial Intelligence

Mycelial's platform uses artificial intelligence to automatically process information provided by users, including Personal Information, to increase and enhance the connections between users.

Under the laws of some jurisdictions, this may be considered profiling or automated decision-making. Notably, our use of AI does not result in a consequential decision or otherwise produce legal or similarly significant effects.

Some of the business partners, vendors, service providers, and other third parties we use to support our business may use the Personal Information we collect from you to help train their machine learning or artificial intelligence models.

Your Rights and Choices

Mycelial strives to provide you with choices regarding your Personal Information. We have created mechanisms to provide you with the following control over your information:

Cookies and Other Tracking Technologies. If you would like more information about how you may exercise control over the information automatically collected through our Site, please see our Cookie Notice.

Marketing, Email, and SMS. We may contact you regarding our Services, such as to deliver transactional or service-related communications, to respond to your requests, or with offers for Services we think you will find valuable. We respect your rights related to marketing communications, and we enforce internal policies to preserve your rights. If you do not want us to send you marketing communications, you may "opt out" at any time by unsubscribing or contacting us directly. You can unsubscribe by following the instructions in the applicable communication you received from us.

Opting Not to Provide Personal Information. If you choose not to provide Personal Information, you can still visit most areas of our Site and may be able to obtain certain Services; however, you will not have access to the Services that require Personal Information.

You have certain rights regarding your Personal Information:

  • Confirm whether we Process your Personal Information.
  • Access your Personal Information.
  • Delete certain Personal Information.
  • Correct inaccuracies in your Personal Information, taking into account the information's nature and Processing purpose.
  • Obtain a copy of your Personal Information.
  • Opt-out of Personal Information Processing for:
    • targeted advertising;
    • sales; or
    • the use of automated decision making or profiling in furtherance of decisions that produce legal or similarly significant effects.
  • Either limit (opt-out of) or require consent to process Sensitive Personal Information.
  • Not be discriminated against for exercising your privacy rights.

The exact scope of these rights may vary by location. As additional jurisdictions enact additional rights on behalf of their residents, we will comply with such laws to the extent they are applicable to our activities. This Notice is not intended to be an exhaustive list of all such rights now or in the future.

We will not discriminate against you because you exercise these rights, but the deletion or cessation of collection of information may result in cancellation of Services initially provided to you or our inability to provide Services to you.

Shine the Light Law

California's "Shine the Light" law permits consumers that are California residents to request certain information regarding our disclosure of Personal Information to third parties for their direct marketing purposes. Please note, we do not disclose your Personal Information to third parties for their direct marketing purposes.

Exercising Your Rights

Please note that you will need to verify your identity before we can fulfill your request. Your request must provide sufficient information that allows us to reasonably verify that you are the person about whom we collected Personal Information or an authorized representative of that person and describe the request with sufficient detail that allows us to properly understand, evaluate, and respond to it. We will only use Personal Information provided in a verifiable consumer request to verify the requestor's identity or authority to make the request. We will respond to your verifiable request within any prescribed timelines. In some jurisdictions, there may be limitations on how often a request relating to Personal Information may be submitted.

Appointing an Authorized Agent

You may designate an authorized agent to submit a request on your behalf, subject to proof of identity and written authorization as required under the applicable privacy law. As part of our verification process, we may request that the agent provide, as applicable, proof concerning their status as an authorized agent. In addition, we may require that you verify your identity as described above or confirm that you provided the agent permission to submit the request.

Appeals

In some locations, you may be able to appeal a decision relating to a Personal Information request. If you would like to appeal, you may do so within a reasonable period after you have received our response to your request. You may file an appeal by contacting us in the same manner as you did to exercise your rights (provided above).

Data Retention

Except as otherwise permitted or required by applicable law or regulation, Mycelial will only retain your Personal Information for as long as necessary to fulfill the purposes we collected it for, as required to satisfy any legal, accounting, or reporting obligations, or as necessary to resolve disputes. To determine the appropriate retention period for Personal Information, we consider applicable legal requirements, the amount, nature, and sensitivity of the Personal Information, the potential risk of harm from unauthorized use or disclosure of your Personal Information, the purposes for which we Process your Personal Information, and whether we can achieve those purposes through other means.

Data Security

Mycelial uses physical, electronic, and administrative safeguards designed to protect your Personal Information from loss, misuse, and unauthorized access, use, alteration, or disclosure.

We require service providers to maintain data protections consistent with the amount, nature, and sensitivity of the Personal Information they are Processing and best practices. We do not guarantee that our safeguards will always work.

The safety and security of your information also depends on you. We urge you to take care when providing information that is available to the public, such as reviews or on our social media pages.

Unfortunately, the transmission of information via the internet is not completely secure. Although we do our best to protect your Personal Information, we cannot guarantee the security of your Personal Information transmitted to us. Any transmission of Personal Information is at your own risk. We are not responsible for the circumvention of any privacy settings or security measures.
